Debt collector's alleged tactics lead to lawsuit

There is an unprecedented lawsuit against Bank of America and a debt collector it hired. A Cape Coral woman wants them to pay up after she says they harassed her about her late husband's debts.

The plaintiff's attorney is already calling this a landmark victory for everyone who gets harassing phone calls from debt collectors.

While the case hasn't gone to trial yet, a Lee County judge ruled Linda Long can seek punitive damages against the bank and the debt collectors, West Asset Management.

Part of the lawsuit's goal to stop the debt collector's tactics.

In the lawsuit, the plaintiff's attorney, Billy Howard of Morgan and Morgan, accuses the debt collectors of using "psychological warfare" on grief-stricken family members in the hopes of collecting the unpaid debts of deceased family members - debts the family members do not personally owe.

Long claims Bank of America's debt collectors harassed her, trying to collect on a $16,000 credit card debt left when her husband suddenly died of colon cancer.

We obtained this audio clip from one of the collection calls.

It begins right after the widow tells the debt collector she only has $2,000 left to her name.

Debt Collector: You don't think the family's in a position to help you out with that, and get this taken off your plate?
Long: I doubt it, but I could try to give you $2,000 just out of his life insurance, but then I won't have much left. But that's fine I can do that, anything to just get this off my head.

The defendants refused to comment on the pending litigation.

A jury will hear the matter at trial next August.

It's important to remember that debt doesn't go away when a person dies. It's their estate that is responsible for those debts.

If there isn't any money in the estate, typically it goes unpaid.

But - with few exceptions - family members are not personally responsible and do not owe the "deceased debt" collectors.

An official with West Asset Management sent us the following statement Wednesday evening:

"West continues to deny any wrongdoing and stands by it's stated court position that West did not violate any laws."

Fixed mortgage rates end year above record lows (AP)

WASHINGTON ? Fixed mortgage rates rose slightly this week off their record lows. The year ends much like it began, with few people able to take advantage of the best rates in history.

Freddie Mac said Thursday that the average on the 30-year home loan increased to 3.95 percent from 3.91 percent. Last week's rate was the lowest average on records dating to the 1950s.

The average on the 15-year fixed mortgage rose to 3.24 percent. That's up from 3.21 percent, also a record low.

Rates have been below 5 percent for all but two weeks in 2011. Even so, this year is shaping up to be one of the worst ever for home sales.

Previously occupied homes are selling just slightly ahead of last year's dismal pace. And new-home sales appear headed for their worst year on records going back half a century.

Next year could be better. More than 5 percent of households said this month they plan to purchase a home within the next six months, according to the Conference Board.

Builders are also hopeful that the low rates could boost sales next year. Low mortgage rates were cited as a key reason the National Association of Home Builders survey of builder sentiment rose in December to its highest level in more than a year.

But so far, rates are having no major impact. Mortgage applications have fallen slightly in recent weeks, according to the Mortgage Bankers Association.

High unemployment and scant wage gains have made it harder for many people to qualify for loans. Many Americans don't want to sink money into a home that they fear could lose value over the next few years.

To calculate the average rates, Freddie Mac surveys lenders across the country Monday through Wednesday of each week. The average rates don't include extra fees, known as points, which most borrowers must pay to get the lowest rates. One point equals 1 percent of the loan amount.

The average fee for the 30-year loan was unchanged at 0.7; the average on the 15-year fixed mortgage was unchanged at 0.8.

For the five-year adjustable loan, the average rate rose to 2.88 percent from 2.85 percent. The average on the one-year adjustable loan ticked up to 2.78 percent from 2.77 percent.

The average fees on the five- and one-year adjustable-rate loans were unchanged at 0.6.

Paul gets front-runner's welcome in Iowa (AP)

NEWTON, Iowa ? Texas Rep. Ron Paul received a welcome befitting a man with a suddenly serious chance to win next week's Iowa Republican presidential caucuses as he arrived in the state Wednesday for a final burst of campaigning.

His rivals attacked him, one by one.

If the 76-year-old libertarian-leaning conservative was bothered, he didn't let it show. He unleashed a television commercial that hit Mitt Romney and Newt Gingrich. In his remarks, he lumped all his rivals into one unappealing category.

"There's a lot of status quo politicians out there," Paul told a crowd of a few dozen potential caucus-goers who turned out to hear him on the grounds of the Iowa Speedway. "If you pick another status quo politician nothing's going to change."

The audience applauded, but by day's end, it appeared that yet another contender might be rising.

According to public and private polls, former Pennsylvania Sen. Rick Santorum is gaining ground in the final days of the race, yet another unpredictable turn in a fast-changing caucus campaign. "We have the momentum," he proclaimed.

The politicking was unending.

Paul got a welcome surprise ? and rival Michele Bachmann an embarrassing one ? when the state chairman of the Bachmann campaign announced Wednesday night that he was throwing his support to Paul. The endorsement came just hours after he had appeared with the Minnesota congresswoman.

Iowa State Sen. Kent Sorenson said he was switching from Bachmann to Paul because the Texas congressman was the most conservative of the top-tier candidates, an assessment sure to encourage those who want Bachmann to drop out of the race and free up her supporters for a conservative candidate with stronger backing.

Two politically active pastors in Iowa's robust evangelical conservative movement were already pushing that idea. They disclosed an effort to persuade either Santorum or Bachmann to quit the race and endorse the other.

"Otherwise, like-minded people will be divided and water down their impact," said Rev. Cary Gordon, a Sioux City minister and a leader among Iowa's social conservatives.

There was no sign either contender was interested.

For months, Romney has remained near or at the top of public opinion surveys in Iowa, as Bachmann, Texas Gov. Rick Perry, businessman Herman Cain and former House Speaker Newt Gingrich rose briefly to challenge him.

Romney has bent without breaking in the face of each challenge, benefiting from his own well-funded campaign, attack advertisements funded by deep-pocketed allies and the missteps of his challengers.

Paul's surge represents the latest threat, and in some respects, the unlikeliest, coming from a man whose views on abortion, the war in Iraq, Iran and other issues are at odds with those of most Republicans.

At the same time, his anti-government appeal appears to tap into the desire of a frustrated electorate for profound change in an era of high unemployment and an economy that has only slowly recovered from the recession.

"In the last couple of weeks I fell into Ron Paul's camp," said Bob Colby, of Newton, who spent 21 years in the military and is a former employee at a now-shuttered Maytag plant in town.

"I threw my hands up" in frustration, said Colby, who added that he supported Romney in the 2008 caucuses and chose Sen. John McCain over Barack Obama that fall.

In his remarks, Paul drew applause when he said, "I want to cut $1 trillion out of the budget the first year," and eliminate deficits in three.

"The debt is unsustainable once it reaches a certain point," he said. "My whole effort is to face up to it."

Paul strongly suggested the United States withdraw its troops from Asia, and drew laughter from the audience when he noted Obama's recent announcement that Marines would be deployed to Australia.

"How long do we have to stay in Korea? We've been there since I was in high school," he said, making no mention of the recent death of North Korean leader Kim Jong Il and the resulting uncertainty about the nuclear-armed nation.

Nor did Paul refer in his remarks to his recent statement in a campaign debate that he would not consider pre-emptive military action to block Iran from acquiring nuclear weapons.

His campaign released an ad that showed pictures of Romney and Gingrich as the narrator said "serial hypocrites and flip-floppers can't clear up the mess" in Washington. "Paul's the one we've been looking for."

His rivals weren't nearly as reticent about discussing a nuclear Iran.

"You don't have to vote for a candidate who will allow Iran to have a nuclear weapon to wipe Israel off the face of the Earth. Because America will be next. I mean, I'm here to say: You have a choice," Perry told an early morning audience near Des Moines.

"I'm very uncomfortable with the idea that the commander in chief would think it was irrelevant to have an Iranian nuclear weapon," said Gingrich.

The former speaker has said he could not support Paul in a general election campaign, a position that Romney and Santorum disagreed with during the day.

Even so, Romney also took a poke at Paul. "One of the people running for president thinks it's OK for Iran to have a nuclear weapon. I don't," he said in response to a question from a potential caucus-goer in Muscatine.

Santorum attacked from a different angle.

Acknowledging widespread voter anger in an age of high unemployment, he said: "If you want to stick it to the man, don't vote for Ron Paul. That's not sticking it to anybody but the Republican Party."

In a campaign that began months ago, Santorum stands out as the only contender who has not experienced a surge in the statewide public opinion polls. There was a hint during the day in a CNN survey as well as private polls that he might be peaking at exactly the right moment.

"We're very, very happy with the new numbers," he told reporters in Dubuque. "We're seeing our numbers go up in a lot of polls."

He's told his recent audiences that he faces the challenge of persuading Iowa Republicans that he has a chance to win.

Santorum has campaigned extensively in the state, spending parts of more than 250 days and stopping in each of Iowa's 99 counties.

Yet he has been low on funds, and while Romney, Perry and Paul have been advertising on television for weeks, Santorum began only recently.

John Legend engaged to model Chrissy Teigen (AP)

NEW YORK ? John Legend will no longer be a bachelor: He's engaged.

The singer's publicist said Tuesday that Legend proposed to his girlfriend, model Chrissy Teigen, recently in the Maldives.

No more details are being provided.

Legend has won nine Grammys and released four albums. Teigen was named "rookie of the year" in the Sports Illustrated's annual swimsuit issue last year. She also has a food blog.

Legend turns 33 Wednesday.

DETROIT ? The last time the Lions took a victory lap around Ford Field to share joy with the fans was in 2009, coming off the 0-16 season and two straight losses to start the year.

When they beat the Redskins on Sept. 27, they thanked the fans by high-fiving them as they walked along the field.

?Coach Schwartz told us late in the fourth when the game was in hand to go ahead and do that," quarterback Matthew Stafford said. ?I thought it was a great gesture and our fans responded great."

The fans are important to this franchise and it starts at the top.

With the players it starts with Schwartz, who led the players single file around the brick wall that separates the seats from the field.

?Unless something really strange happens, it?s probably the last home game that we?re going to play this year," Schwartz said. ?So our crowd?s made a big difference. We?ve said all along how they don?t just go to the games, they participate in the games. I?d like a few less waves when our offense has the ball when we?re holding the lead and we don?t want to get any penalties, but our crowd?s been great and they deserve to celebrate it and that?s why we stayed out."

With Schwartz in the lead, Stafford picked up the rear of the formation. Linebacker Bobby Carpenter shared the experience with his son, who he was holding in his arms.

The team has come a long way since that lap in 2009, the first season with Schwartz and Stafford.

?It?s been a long road, that?s for sure. For me personally, for our team, for everybody involved. (There?s) a lot of mentally tough people in that locker room ? a lot of people (who) have been through a lot of hard times to get to this point and you know I?m just happy to be a part of it and glad I got to share it with the guys in the locker room there. They?re a great bunch of guys and it?s just fun to be a part of it," Stafford said.

Islamists kill dozens in Nigeria Christmas bombs (Reuters)

ABUJA (Reuters) ? Islamist militants set off bombs across in Nigeria on Christmas Day - three targeting churches including one that killed at least 27 people - raising fears that they are trying to ignite sectarian civil war.

The Boko Haram Islamist sect, which aims to impose sharia law across the country, claimed responsibility for the three church bombs, the second Christmas in a row the group has caused mass carnage with deadly bombings of churches. Security forces also blamed the sect for two other blasts in the north.

St Theresa's Catholic Church in Madala, a satellite town about 40 km (25 miles) from the center of the capital Abuja, was packed when the bomb exploded just outside.

"We were in the church with my family when we heard the explosion. I just ran out," Timothy Onyekwere told Reuters. "Now I don't even know where my children or my wife are. I don't know how many were killed but there were many dead."

Hours after the first bomb, blasts were reported at the Mountain of Fire and Miracles Church in the central, ethnically and religiously mixed town of Jos, and at a church in northern Yobe state at the town of Gadaka. Residents said many were wounded in Gadaka, but there were no immediate further details.

A suicide bomber killed four security officials at the State Security Service in one of the other bombs, which struck the northeastern town of Damaturu, police said. Residents heard two loud explosions and gunfire in the town.

A Reuters reporter at the church near Abuja saw the front roof had been destroyed, as had several houses nearby. Five burnt out cars were still smoldering. There were scenes of chaos, as shocked residents stared at the wreckage in disbelief.

"Mass just ended and people were rushing out of the church and suddenly I heard a loud sound: 'Gbam!' Cars were in flames and bodies littered everywhere," Nnana Nwachukwu told Reuters.

Father Christopher Barde, Assistant priest of the church, said: "The officials who counted told me they have picked up 27 bodies so far."

"I happen to also live close by the church. Help was very slow in coming to the injured," he said.

Police cordoned off the area around the church. Thousands of furious youths set up burning road blocks on the highway from Abuja leading to Nigeria's largely Muslim north.

Police and the military tried to disperse them by firing live rounds into the air with tear gas.

"We are so angry," shouted Kingsley Ukpabi, as a queue of hooting vehicles lined up behind his flaming barrage.

ATTACKS INCREASE

Boko Haram - which in the Hausa language spoken in northern Nigeria means "Western education is sinful" - is loosely modeled on the Taliban movement in Afghanistan.

It has emerged as the biggest security threat in Nigeria, a country of 160 million split evenly between Christians and Muslims, who for the most part live side by side in peace.

Boko Haram's low level insurgency used to be largely confined to northeastern Nigeria, but it has struck several parts of the north, center and the capital Abuja this year.

Last Christmas Eve, a series of bomb blasts around Jos killed 32 people, and other people died in attacks on two churches in the northeast.

The sophistication of the explosives it uses and the number of attacks it carries out have increased this year.

The sect was blamed for dozens of bombings and shootings in the north, and has claimed responsibility for two bombings in Abuja this year, including Nigeria's first suicide bombing, which killed at least 23 people at the U.N. headquarters.

Rights groups say more than 250 people have been killed by Boko Haram since July 2010.

At the church near Abuja, a wounded man whose legs were almost shattered to pieces by the blast was loaded onto a stretcher near an ambulance by security services.

"I'll survive," he said in a hushed voice.

The blast in Jos, a tinderbox of ethnic and sectarian tensions that sometimes sees deadly clashes between Muslims and Christians, was accompanied by a shooting spree by militants, who exchanged fire with local police, said Charles Ezeocha, special taskforce spokesman for Jos.

"We lost one policeman and we have made four arrests. I think we can use them to get more information and work on that," he said. Police found four other explosive devices in Jos, which they deactivated, he added.

President Goodluck Jonathan, a Christian from the south who is struggling to contain the threat of Islamist militancy, called the incidents "unfortunate" but said Boko Haram would "not be (around) for ever. It will end one day."

The White House condemned "this senseless violence and tragic loss of life on Christmas Day." A statement said: "We have been in contact with Nigerian officials about what initially appear to be terrorist acts and pledge to assist them in bringing those responsible to justice."

Vatican spokesman Father Federico Lombardi said the Vatican hoped "this senseless violence does not weaken the will of the Nigerian people to live peacefully and promote dialogue."

The attacks were condemned by a number of other countries, including Britain, France and Italy.

Gun battles between the security forces and Boko Haram killed at least 68 people Thursday and Friday in northern Nigeria, authorities and hospital sources said Saturday.

Boko Haram became active in about 2003 and is concentrated mainly in the northern Nigerian states of Yobe, Kano, Bauchi, Borno and Kaduna.

The group considers all who do not follow its strict ideology as infidels, whether they are Christian or Muslim. It demands the adoption of sharia, Islamic law, in all of Nigeria.

"Nigerian Taliban" church bombings kill scores

LAGOS, Nigeria - An explosion ripped through a Catholic church during Christmas Mass near Nigeria's capital Sunday, killing at least 25 people, officials said. A radical Muslim sect waging an increasingly sophisticated sectarian fight claimed the attack and another bombing in the restive city of Jos, as explosions also struck the nation's northeast.

The Christmas Day attacks show the growing national ambition of the sect known as Boko Haram, which is responsible for at least 491 killings this year alone, according to an Associated Press count. The group's fundamentalist views and violent ways have earned them the nickname "Nigerian Taliban." The Christmas assaults come a year after a series of Christmas Eve bombings in Jos claimed by the militants left at least 32 dead and 74 wounded.

The first explosion on Sunday struck St. Theresa Catholic Church in Madalla, a town in Niger state close to the capital, Abuja, authorities said. Rescue workers recovered at least 25 bodies from the church and officials continued to tally those wounded in various hospitals, said Slaku Luguard, a coordinator with Nigeria's National Emergency Management Agency.

His agency already has acknowledged it didn't have enough ambulances immediately on hand to help the wounded. Luguard also said an angry crowd that gathered at the blast site hampered rescue efforts as they refused to allow workers inside.

"We're trying to calm the situation," Luguard said. "There are some angry people around trying to cause problems."

In Jos, a second explosion struck near a Mountain of Fire and Miracles Church, government spokesman Pam Ayuba said. Ayuba said gunmen later opened fire on police guarding the area, killing one police officer. Two other locally made explosives were found in a nearby building and disarmed, he said.

"The military are here on ground and have taken control over the entire place," Ayuba said.

The city of Jos is located on the dividing line between Nigeria's predominantly Christian south and Muslim north. Thousands have died in communal clashes there over the last decade.

After the bombings, a Boko Haram spokesman using the nom de guerre Abul-Qaqa claimed responsibility for the attacks in an interview with The Daily Trust, the newspaper of record across Nigeria's Muslim north. The sect has used the newspaper in the past to communicate with public.

The U.S. Embassy in Nigeria's capital of Abuja had issued a warning Friday to citizens to be "particularly vigilant" around churches, large crowds and areas where foreigners congregate.

Several days of fighting in and around the northeastern city of Damaturu between the sect and security forces already had killed at least 61 people, authorities said. On Sunday, local police commissioner Tanko Lawan said two explosions struck Damaturu, including a blast near government offices. He declined to comment further, saying police had begun an operation to attack suspected Boko Haram sect members.

In the last year, Boko Haram has carried out increasingly bloody attacks in its campaign to implement strict Shariah law across Nigeria, a nation of more than 160 million people.

Boko Haram claimed responsibility for a Nov. 4 attack on Damaturu, Yobe state's capital, that killed more than 100 people. The group also claimed the Aug. 24 suicide car bombing of the U.N. headquarters in Nigeria's capital that killed 24 people and wounded 116 others.

The sect came to national prominence in 2009, when its members rioted and burned police stations near its base of Maiduguri, a dusty northeastern city on the cusp of the Sahara Desert. Nigeria's military violently put down the attack, crushing the sect's mosque into shards as its leader was arrested and died in police custody. About 700 people died during the violence.

While initially targeting enemies via hit-and-run assassinations from the back of motorbikes after the 2009 riot, violence by Boko Haram now has a new sophistication and apparent planning that includes high-profile attacks with greater casualties.

Boko Haram has splintered into three factions, with one wing increasingly willing to kill as it maintains contact with terror groups in North Africa and Somalia, diplomats and security sources say.

Sect members are scattered throughout northern Nigeria and nearby Cameroon, Chad and Niger.

Financial Fraud Against Older Americans Peaks this Holiday ...

If this year is anything like last, baby boomers and older Americans should be on guard this holiday season. Instances of financial abuse and fraud against the elderly increased from November 2010 to January 2011, according to a recent report from MetLife, which found overall investment fraud targeted towards older Americans is on the rise.

Americans over the age of 65 lost nearly $3 billion to financial abuse from April to June 2010, up 12% from the same period in 2008, according to the report. During that time, 51% of the fraud cases reported were perpetrated by strangers, 34% by family, friends and neighbors and 12% by businesses.

But in a separate look at the holidays, MetLife reports fraud by family and friends increased to 45%.

With the baby boomer generation reaching retirement age and comprising 25% of the U.S. population, financial investment fraud is becoming a bigger and more problematic issue facing the country.

The North American Securities Administrators Association found the number of criminal complaints and enforcement actions at the state level against investors 50 years or older more than doubled in 2010 from 2009, reports The Wall Street Journal. And state security officials expected the number of enforcements actions for fraud against that same age group to hit a record this year.

Not only are the boomers older and more vulnerable, but "they tend to have more assets that they tend to rely on to live out through retirement years," says Raj Date, Special Advisor to the Secretary of the Treasury and acting head of the Consumer Financial Protection Bureau. This combo makes them a more "attractive pray for would be scammers."

Coupled with the fact that the Dow Jones Index is down nearly 15% since its high back in Oct. 2007, that's a recipe for disaster. As older investors who have lost much of their retirement look for quick fixes to recoup losses, they become even easier targets of fraud.

"It is a real problem today and at the CFPB we want to make sure that we get out ahead of problems before they become more serious," says Date.

In an effort to do so, the consumer watchdog has launched the office of Financial Protection for older Americans to help educate seniors on all types of investment matters, including fraud. For more information consumer and investors can visit the Consumer Financial Protection Bureau's website.

In the meantime, Date does have one piece of advice to guard against fraud against older Americans.

"If it sounds too good to be true you should probably look again, because most things that seem too good to be true, in fact are not true," he says.

That may be a truism, but it's one everyone can benefit from in every area of our lives.

Stocks close higher on better job market news

(AP) ? Encouraging economic reports pushed stocks higher Thursday. The Dow Jones industrial average rose 61 points, its third gain in a row.

The number of people applying for unemployment benefits dropped last week to the lowest level since April 2008, the latest sign that the job market is healing. It was the third week in a row that applications fell. The Conference Board also reported that its measure of future economic activity had a big increase last month. It was the second straight gain, signaling that the U.S. economy was picking up speed and the risk of another recession was fading.

"Today, Main Street is what matters because Main Street makes up 71 percent of the economy," said Quincy Krosby, chief market strategist for Prudential Securities. "You can't argue with the fact that the cost of gas has come down, which puts more money in the pockets of consumers to spend, and so things are starting to tick up."

Krosby noted that the latest data showed that shoppers were opening up their wallets to spend during the holidays. However, she said the economy needs to grow at a faster pace than 2 percent to be able to survive any shocks caused by the European debt crisis or a sharp slowdown in China's economy in 2012.

The government lowered its estimate of U.S. economic growth in the July-September quarter to an annual rate of 1.8 percent from 2 percent. That was still the fastest growth this year, up from 1.3 percent in the April-June quarter.

The Dow Jones industrial average rose 61.91 points, or 0.51 percent, to close at 12,169.65. The Dow has risen 409 points over the past three days. Bank of America Corp. rose 4.6 percent to $5.47, the most among the 30 stocks in the Dow.

The S&P 500 index gained 10.28 points, or 0.83 percent, to 1,254. The Nasdaq composite index rose 21.48, or 0.83 percent, to 2,599.45.

Economists say that the improving job market, strong holiday shopping, and cheaper gas prices will leave consumers with more money to spend. That would get the economy growing at an annual rate of more than 3 percent in the final three months of this year, which would be the fastest pace since 3.8 percent growth in the spring of 2010.

Banks, energy and technology stocks were the biggest gainers, while consumer goods companies traded lower. Morgan Stanley led bank stocks, gaining 6.5 percent to close at $15.88, while among tech stocks Akamai Technologies Inc. the biggest gainer, rising 18.6 percent to $31.63.

In other corporate news:

? Mead Johnson Nutrition Co. plummeted 10 percent on news that Wal-Mart Stores Inc. pulled a batch of its powdered infant formula from more than 3,000 of its stores nationwide. A newborn Missouri boy was fed a batch of the Enfamil Newborn powder made by Mead and died from what preliminary tests indicate was a rare bacterial infection. So far, no link has been established between the death and the formula and the government has not ordered a recall of Enfamil.

? Tibco Software Inc. jumped 8 percent after the business software maker reported a 20 percent increase in revenue and net income that was far ahead than what Wall Street analysts were expecting.

? Bed, Bath & Beyond Inc. slid 6 percent after the retailer warned investors that its fourth-quarter earnings might be lower than analysts had expected. Third-quarter sales also fell below analysts' expectations.

With just over a week of trading left in 2011, the S&P 500 is less than 1 percent below where it started the year. The Dow has managed to gain 5.1 percent in 2011, while the Nasdaq is still off 2 percent.

Nearly three stocks gained for every one that fell on the New York Stock Exchange. Trading volume was very light at 3.5 billion, compared to the recent average of 4.6 billion.

Suit renews fraud claims against NFL, Cowboys

DALLAS (AP) - Super Bowl ticket-holders displaced during the February seating fiasco at Cowboys Stadium filed court documents, renewing fraud claims against the NFL and the Dallas Cowboys.

The Wednesday filings in Dallas accuse the league and Cowboys owner Jerry Jones of recklessness in pushing for a new Super Bowl attendance record at the Cowboys' new stadium and doing nothing to discourage attendance.

That's despite no league and Cowboys responses to Arlington building inspectors' warnings that permits hadn't been sought for temporary seating being installed for the game. Eventually, 1,250 temporary seats were declared unsafe just hours before the game.

A judge dismissed previous fraud allegations and claims against the Cowboys, but allowed the ticketholders to amend their claims.

Cowboys spokesman Rich Dalrymple declined comment. NFL spokesman Brian McCarthy called the claims meritless.

Thirsty? You may be more inclined to reach for plain old H2O if you knew how many calories are in sugar-sweetened beverages; this is according to a new study led by researchers at the Johns Hopkins Bloomberg School of Public Health. They examined the effect of providing clear and visible caloric information about sugar-sweetened beverages such as soda and fruit juice on the number of sugar-sweetened beverage purchases at neighborhood stores, and found that providing easily understandable caloric information, specifically in the form of a physical activity equivalent, may reduce the likelihood of sugar-sweetened beverage purchases among adolescents by as much as half. The results are featured in a recent issue of the American Journal of Public Health.

"People generally underestimate the number of calories in the foods and beverages they consume," said Sara Bleich, PhD, assistant professor with the Bloomberg School's Department of Health Policy and Management. "Providing easily understandable caloric information?particularly in the form of a physical activity equivalent, such as running?may reduce calorie intake from sugar-sweetened beverages and increase water consumption among low-income black adolescents."

Researchers conducted the study at four corner stores located in low-income, predominately black neighborhoods in Baltimore, Md. For the intervention, one of three caloric information signs were randomly posted with the following information: "Did you know that a bottle of soda or fruit juice has about 250 calories?" (absolute caloric count); "Did you know that a bottle of soda or fruit juice has about 10 percent of your daily calories?" (percentage of total recommended daily intake); and "Did you know that working off a bottle of soda or fruit juice takes about 50 minutes of running?" (physical activity equivalent). They collected data for 1,600 beverage sales to black adolescents, aged 12-18 years, including 400 during a baseline period and 400 for each of the 3 caloric-condition interventions. Researchers found that providing participants with any caloric information significantly reduced the odds of sugar-sweetened beverage purchases by 40 percent relative to the baseline of no information. Of the three caloric-condition interventions, the physical activity equivalent was most effective, reducing the odds of black adolescents purchasing a sugar-sweetened beverage by 50 percent.

Consumption of sugar-sweetened beverages such as soda, sport drinks, energy drinks and fruit drinks has been associated with obesity and is highest among minority and lower income adolescents. According to the Centers for Disease Control and Prevention (CDC), more than one third of U.S. adults and 17 percent of U.S children are obese. Obesity increases the risk of many adverse health conditions including type 2 diabetes, coronary heart disease, stroke, and high blood pressure.

"Because of the inclusion of mandatory calorie labeling in the recent health reform bill, it is critical to explore the most effective strategies for presenting caloric information to consumers on fast food restaurant menu boards," suggest the study's authors.

Budget deficits not Obama's fault

Before the President took office, fiscal conditions had deteriorated to the point that what was a projected surplus in 2012 was now a deficit.

Jon Chait has a piece up today, amplified by Paul K, wherein he justly criticizes a piece of extremely sloppy ?analysis? blaming recent budget deficits on President Obama.?? The author?s evidence for this phony claim is that in Jan 2008, CBO projected surpluses by 2012.? Since we will in fact have deficits in 2012, and Obama entered the scene in the interim, it?s got to be all his fault.
