Switched On: You tell me it's the institution

Each week Ross Rubin contributes Switched On, a column about consumer technology.

Apple rose to dominate sales of digital music by more or less mirroring the way consumers acquired music in the physical world -- that is, purchasing songs, but providing a greater degree of granularity. This worked well for music and has also held true for apps and best-selling books, but hasn't been as in step with consumer media acquisition habits for other content.

For example, before Apple brought sales of video material to iTunes, most consumers did not generally own TV shows except for perhaps a few cherished series on DVD. They either watched them as they aired as part of a cable-like subscription or paid a flat monthly fee for the privilege of recording them on a DVR to be viewed after they aired. Furthermore, both Blockbuster physical stores and later Netflix's DVD by mail feature relied on a system of one-time consumption via rental or subscription that eschewed ownership of movies. And today, Vevo.com offers free streaming of many music videos that Apple still seeks to sell.

Gingrich says he's in 'til GOP convention (AP)

PORT ST. LUCIE, Fla. ? On the weekend before the pivotal Florida primary, Newt Gingrich vowed Saturday to stay in the race for the Republican presidential nomination until the national convention this summer even if he loses Tuesday's vote. Front-runner Mitt Romney poured on the criticism of his rival in television ads airing across the state.

Gingrich's pledge, followed several hours later by an endorsement from campaign dropout Herman Cain, raised the prospect of an extended struggle inside the party as Republicans work to defeat President Barack Obama in the fall. "You just had two national polls that show me ahead," he said. "Why don't you ask Gov. Romney what he will do if he loses" in Florida.

The former Massachusetts governor countered a few hours later while in Panama City. "I think we are going to win here, I sure hope so," he said.

As the two rivals made their appeals to Hispanic, Jewish and tea party voters, veterans of the armed forces and others, all known indicators pointed to a good day for Romney in the primary.

He and his allies held a 3-1 advantage in money spent on television advertising in the race's final days. Robust early vote and absentee ballot totals followed a pre-primary turnout operation by his campaign. Even the schedules the two men kept underscored the shape of the race ? moderate for Romney, heavy for Gingrich.

Campaigning like a front-runner, Romney made few references to Gingrich. Instead, he criticized Obama's plans to cut the size of the armed forces. "He's detached from reality," the former Massachusetts governor said.

"The foreign policy of `pretty please' is not working terribly well," he added. Romney said he wants to add 100,000 troops, not cut them.

If his personal rhetoric was directed Obama's way, the television commercials were trained on Gingrich, whose victory in last Saturday's South Carolina primary upended the race for the nomination. A new ad released as the weekend began is devoted to the day in 1997 when Gingrich received an ethics reprimand from the House while serving as speaker and was ordered to pay a $300,000 fine.

Nearly the entire 30-second ad consists of NBC News anchor Tom Brokaw's nationally broadcast description of the events on the evening news. "By an overwhelming vote, they found him guilty of ethics violations; they charged him a very large financial penalty, and they raised ? several of them ? raised serious questions about his future effectiveness," Brokaw said that night, and now again on televisions across Florida.

Both NBC and the former newsman registered objections. The network called on the campaign to stop using the footage and Brokaw said in a statement, "I do not want my role as a journalist compromised for political gain by any campaign."

A Romney adviser, Eric Fehrnstrom, said the campaign wasn't likely to stop running the ad. "We believe it falls within fair use," he said. "We didn't take the entire broadcast; we just took the first 30 seconds."

Whatever its impact, the ad represented part of a barrage that Gingrich could not match.

A second Romney ad said Gingrich had "cashed in" as a Washington insider while the housing crisis was hitting Florida particularly hard.

Figures made available to The Associated Press showed Romney was spending $2.8 million to air television commercials in the final week of the Florida campaign. In addition, a group supporting him, Restore Our Future, was spending $4 million more, for a combined total of $6.8 million.

By contrast, Gingrich was spending about $700,000, and Winning Our Future, a group backing him, an additional $1.5 million. That was about one-third the amount for the pro-Romney tandem.

Officials said the total of absentee and early vote cast approached 500,000, about 200,000 of them before Gingrich won in South Carolina last weekend.

Cain's endorsement came at a GOP dinner in West Palm Beach. The business executive led briefly in the polls last fall, then cratered and dropped out of the race after he was accused of sexual harassment and marital infidelity.

In supporting the former speaker, he followed an example set by Texas Gov. Rick Perry, who bestowed his endorsement a few days before the South Carolina primary.

Gingrich seemed in good humor during the day, despite the obstacles in his way. He joked with reporters that they had missed an example of his grandiosity ? a charge that one rival, former Pennsylvania Sen. Rick Santorum, had used in a recent debate ? when they didn't see him hold a golf trophy on display at the PGA Library.

Gingrich also turned aside one opportunity to criticize Romney, answering a question by saying, `I want to talk about defeating Obama."

But his tone seemed to change after he said he wasn't happy with his performances in a pair of debates during the week, and was asked to explain.

"You cannot debate somebody who is dishonest. You just can't," he said, referring to Romney.

Referring to one answer the former Massachusetts governor had given, Gingrich said it was not true that Romney had always voted for a Republican when one was on the ballot.

"That in fact he could have voted for George H.W. Bush or Pat Buchanan the same day and he chose the Democratic primary, he voted Paul Tsongas, the most liberal candidate. The same year he gave money to three Democrats for Congress," he added, referring to the 1992 campaign.

"Now there's no practical way in a civil debate to deal with somebody who is that willing to say something that is just totally dishonest."

Romney poked fun at Gingrich's debate performances.

"This last one Speaker Gingrich said he didn't do so well because the audience was so loud. The one before he said he didn't do so well because the audience was too quiet. This is like Goldilocks, you know, you've got to have it just right.

"When I debate the president, I'm not going to worry about the audience, I'm going to make sure that we take down Barack Obama and take back the White House."

The two other contenders, Santorum and Texas Rep. Ron Paul, have conceded Florida and did not campaign in the state during the day.

Syria's opposition concerned about independent armed rebel groups

A member of the opposition's Syrian National Council told reporters in Paris that the council is concerned about the increasingly militarized rebel groups taking matters into their own hands.?

A leading Syrian opposition figure says that as rebels become increasingly militarized, it is critical that disparate armed groups be integrated with the political opposition so that they are working in concert.?

Bassma Kodmani, a Syrian-French member of the Syrian National Council's 10-member executive board and the council's spokeswoman,?spoke in quiet but urgent terms to a group of foreign correspondents last night, framing the opposition's options as two ?sad? alternatives ???greater militarization? of local resistance or foreign intervention.

The request for international assistance may go unanswered for awhile yet. Members of the United Nations Security Council are grappling over an appropriate response to Syria's violent crisis, which began in March 2011 and has resulted in the death of at least 5,500 Syrians, according to the UN. The US, Britain, and France are pushing for more international involvement, but veto-wielding Russia, backed up by China,?has blocked efforts to do more.

Russia has vowed to oppose a draft resolution drawn up by Western council members and the Arab League,?calling for President Bashar al-Assad's resignation. A vote is expected to happen next week.

Ms. Kodmani said Russia ?holds the keys to change, and for peaceful change? in Syria. If?Moscow ?says tomorrow morning that ? we are no longer supporting Assad? he would be forced to?step down in a matter of weeks, she said.

But that is unlikely, despite reassurances from the SNC that Russian ?interests? in Syria would be fully protected if Assad were forced out.

Of the two options facing the opposition, Kodmani said she prefers outside intervention, even if it is unlikely. Most of the Syrian opposition favors this as well, she said. In the absence of intervention, they at least need "inoffensive equipment," such as radios and bulletproof vests.?

?I grew up hating NATO,? she says. ?I was taught it was the devil. It was unimaginable for decades for any Syrian to even think about asking for [help] from the West.? But now people on the ground want humanitarian intervention. They want to be rescued.?

Strategy Analytics: Nokia tops global handset shipments, Apple sees quarterly surge

Fresh off the publication of its latest tablet report, Strategy Analytics has come out with a new batch of statistics on the global mobile market. In a report published yesterday, the research firm crowned Apple as the world's largest smartphone vendor by volume, on the strength of the 37 million iPhones it shipped during Q4 2011 -- good for 23.9 percent of the market. Samsung wasn't too far behind, though, with 36.5 million smartphones shipped during the quarter, comprising 23.5 percent of the market. Nokia finished in third place, with 19.6 million smartphones and a 12.6 percent market share, though it fared notably better among handset makers on a global (i.e., smartphone and feature phone) level. According to Strategy Analytics, the Finnish manufacturer shipped 417.1 million handsets for the full year, 113.5 million of which were shipped during the fourth quarter of last year. For the year, Nokia accounted for 26.9 percent of the market, followed by Samsung, which shipped 327.4 million units shipped during 2011 and finished with a 23.1 percent market share. As for Apple, it accounted for 8.3 percent of the market in Q4 (its best showing, according to Strategy's metrics), with 37 million quarterly shipments. TV ratings: Fox wins night with "Idol" (Reuters)

LOS ANGELES (TheWrap.com) ? Fox scored a decisive win Wednesday night on the strength of "American Idol" and a preview of the new Kiefer Sutherland drama "Touch," while NBC's new comedy "Are You There Chelsea" dropped significantly to hit a ratings low, according to preliminary numbers.

"Idol," airing at 8 p.m., was down slightly from last week but was easily the night's top-rated and most-watched show of the night, drawing a 6.4 rating/18 share in the adults 18-49 demographic and 19.5 million total viewers. A preview of "Touch" the following hour posted a 3.9/10 in the demographic -- the second-highest drama debut this season, behind ABC's "Once Upon a Time" -- and 11.8 million total viewers. ("Touch" officially premieres March 19.) Combined, "Idol" and "Touch" gave Fox an average 5.2/14 in the demographic and an average 15.6 million total viewers.

On NBC, "Whitney" at 8 p.m. dipped to 1.4/4 in the demographic and 4.4 million total viewers, while "Are You There Chelsea," which premiered to so-so numbers earlier this month, had a 1.4/4 in the demographic and 3.9 million total viewers. It was down 18 percent in the ratings from last week. "Law & Order: SVU" repeats filled out the evening.

Following a "Criminal Minds" repeat at 8 p.m., CBS ran a new "Criminal Minds" at 9 p.m., which was up 13 percent versus last week for a 3.6/9 in the demographic and 13.6 million total viewers. "CSI" the following hour jumped 18 percent over last week, taking a 3.3/9 in the demographic and 14 million total viewers.

ABC ran only repeats.

Japan's NEC to slash 10,000 jobs (Reuters)

TOKYO (Reuters) ? NEC Corp said on Thursday it aims to shed 10,000 jobs by the end of September, and would fail to reach a target to raise sales to 4 trillion yen ($51.13 billion) by March 2013.

The job cuts, which will mean shedding almost one in 10 of its workers, are to trim costs after the electronics maker announced a loss of 87 billion yen ($1.11 billion) for the three months to December 31.

The company, which employs 115,840 people worldwide, said it will book a 40 billion yen charge in the business year ending on March 31 to pay for the restructuring.

It blamed its poor performance on tougher competition in the telecoms infrastructure business in Japan from foreign rivals, weak demand for its smartphones and difficulty in expanding operations overseas.

European Lawmakers Want "Right to Be Forgotten" on Facebook, Google (Mashable)

European Internet users may be getting better control over information posted online, thanks to some proposed sweeping reforms lawmakers proposed Wednesday designed to protect digital privacy. The suggested law calls for a "right to be forgotten" and a "right to data portability." The former would require Internet companies such as Facebook and Google to completely wipe all of a user's info from their servers if such a request was made. The latter demands users be allowed to easily transfer data from one online service to another, a currently difficult task.

The "right to be forgotten" wouldn't be granted to users attempting to remove information relevant to a criminal investigation.

All online businesses operating in Europe would be bound to the new rules, whether or not they're based on the continent. Should web services fail to comply with these rights, they would be slapped with fines of up to ?1 million or up to 2% of the global annual turnover of a company (The total value of all products made in a 12-month period).

In the past, European Union (EU) member states have issued varying interpretations on existing digital privacy laws. Those different analyses have resulted in discordant levels of enforcement from country to country. If passed, this law would unify all 27 EU member states under a single set of privacy rules.

The EU argues this Europe-wide standardization would save businesses money by providing a sole definitive source of online privacy law for the continent. However, many internet companies depend on access to users' data for advertisement revenue.

A spokesman for European Union justice commissioner, Viviane Reding, told the BBC that the proposed laws are a means of protecting children and young adults who share details online which they later want removed for professional or personal reasons.

"These rules are particularly aimed at young people as they are not always as aware as they could be about the consequence of putting photos and other information on social network websites, or about the various privacy settings available," said spokesman Matthew Newman.

For the proposed new rules to become European law, they will need approval from the EU's member states followed by ratification from European Parliament. That process may take up to two years.

GOP candidates weigh in on Cuba policy

(AP) ? All four of the Republican presidential candidates say they'd like to see a Cuba free of Castro's rule, though they differ on how they'd approach relations with Cuba.

Mitt Romney says it's important for the U.S. to stand with people who want freedom, including Cubans.

Newt Gingrich says he would use covert operations and other means to bring down Castro.

Rick Santorum says it's important for the U.S. to deal with Cuba but says he can't foresee a relationship before Fidel Castro and his brother are out of power.

For his part, Ron Paul says he would like to see the Cuban people celebrate their own freedom without any U.S. involvement.

The issue of Cuba looms large in Florida, where there are many Cuban expatriates.

About 12 groups submit Dodgers bids

NEW YORK - About 12 groups submitted initial bids to buy the Los Angeles Dodgers from Frank McCourt, several people familiar with the process said Tuesday.

Among the bidders were Dallas Mavericks owner Mark Cuban and former YES Network chief executive officer Leo Hindery, two people said, speaking on condition of anonymity because the bids were to remain confidential.

One of the people also confirmed a Los Angeles Times report that Stan Kroenke was involved in the bidding. Kroenke already controls the NFL's St. Louis Rams, the NBA's Denver Nuggets, the NHL's Colorado Avalanche, Arsenal of the English Premier League and Major League Soccer's Colorado Rapids.

Hindery's bid, made with Marc Utay, was first reported by the Wall Street Journal.

Bidders said they were waiting to hear from Blackstone Group, which is representing McCourt, what the next step in the process will be. Blackstone may ask Major League Baseball to conduct due diligence on up to 10 bidders, with each chosen group paying MLB $25,000 to cover baseball's costs.

McCourt is to pick his chosen owner by early April, with Major League Baseball approving the sale in time for a transfer by April 30, the day McCourt must pay former wife Jamie a $131 million divorce settlement.

Some of the other groups include former Los Angeles Lakers star Magic Johnson, former Dodgers manager Joe Torre, former Dodgers owner Peter O'Malley and former agent Dennis Gilbert.

'Dark Knight Rises': Who Is Miranda Tate?

We discuss just whom Marion Cotillard is playing in The Weekly Rising.

The topic of this week's column might be considered a spoiler. Admittedly, it's probably the spoiler that most fans already know about, but if you wish to remain uninformed, I suggest you stop reading.

Over the next two weeks, we'll be discussing the two "The Dark Knight Rises" characters that have stirred the most controversy, outside the hugely overblown debacle surrounding Bane's voice.

Almost as soon as Christopher Nolan cast Marion Cotillard and Joseph Gordon-Levitt, fans called "B.S." How could a series with such a storied history for casting great actors as classic characters put Cotillard and Gordon-Levitt in made-up roles like Miranda Tate and John Blake?

The answer is, Nolan wouldn't. Fans saw through the ruse immediately, pointed at Cotillard and cried "Talia al Ghul."

With so much talk swirling around "The Dark Knight Rises" in the early months of its development and confirmation that it would circle back to touch on some themes from "Batman Begins," Talia seemed like a choice candidate for a secondary "Rises" villain. By the time Joey King confirmed that she would be playing young Talia al Ghula, Tate's true identity was all but sealed.

But now we find ourselves in a curious position. With everything but an official press release telling us that Marion Cotillard will play Talia — picking up where her dear old dad, Ra's al Ghul, left off — how will that affect the overall arch of "The Dark Knight Rises"? One of the most common complaints about "The Dark Knight" was Two-Face's uneven role. It was the Joker's movie, and many felt that adding such an iconic villain toward the end of the film didn't do the character justice.

Is Talia destined to become the next Two-Face? It all depends on when Miranda Tate's true identity is revealed. Such a high-profile comic-book adaptation like "The Dark Knight Rises" has to contend with different hazards than a normal film. The Tate-Talia twist could work in a film that didn't feature such well-known characters. Instead, fans have a whole universe of potential true identities to assign if they feel a character is lying, which they did with Tate.

For the reveal to not fall absolutely flat, Nolan would have to introduce the truth in a way that's less "A-ha! I got you!" and more a natural progression of the storyline. A spoiler of this caliber does the least amount of damage when less of the plot depends on its shock value. Attempting to make the Talia reveal a big shocker would feel would be a fool's errand at this juncture.

How Talia will fit into "The Dark Knight Rises" also relies heavily on Bane's final role in the film. The prologue strongly hinted at the presence of a renewed League of Shadows with Bane taking the lead. That still leaves a lot of room for a leader above him, the one giving the orders. This is where Talia is most likely to fit in. So much of what we've seen of the film so far focuses on Bane and his role, but many of the shots come from just a few scenes. The trailer only gave the illusion of showing us a lot. That leaves the majority of the film unseen, and plenty of screen time left for Talia.

On that note, even if Cotillard does end up portraying Talia, it really doesn't spoil all that much. A character's identity will never be a focal point of a story. Nolan is too intelligent of a storyteller to waste his final act on a plot development that people guessed a year out. Nothing that this column or any spoiler sites have uncovered has been essential enough to lessen "The Dark Knight Rises" as a movie. Did knowing about Dent's Two-Face transformation in "The Dark Knight" ruin that movie? No. Expect the same with Talia.

Oil hovers above $100 as gasoline stocks cap rise (AP)

KUALA LUMPUR, Malaysia ? Oil hovered above $100 a barrel Friday in Asia as signs of economic improvement in the U.S. and Europe were tempered by a rise in gasoline stocks, which suggests weaker demand for crude.

Benchmark crude for February delivery was up 28 cents at $100.67 a barrel at late afternoon Kuala Lumpur time in electronic trading on the New York Mercantile Exchange. The contract fell 20 cents to finish at $100.39 on Thursday.

Jobless claims fell, consumer prices were steady and the dismal home construction market showed more signs of life at the end of 2011, raising hopes that the U.S. economic recovery is for real.

Worries about Europe's debt crisis and future energy demand receded as France and Spain staged successful bond auctions, indicating investors have not been scared off by Standard and Poor's recent downgrades of countries that use the euro common currency.

Analysts said the positive economic news was tempered by the weekly U.S. oil inventory report. The Energy Department said Thursday that the nation's crude oil supplies declined about 1 percent last week but gasoline stocks rose 1.7 percent while demand over the past four weeks is down 6.1 percent from a year earlier.

"The market focused on the rising gasoline stocks which indicated continuing weak oil demand in the U.S. This has capped oil futures from gaining further despite some positive economic news from the U.S. and Europe," said Victor Shum, an energy analyst with Purvin & Gertz in Singapore.

Analysts say oil prices will continue to swing between gains and losses until there is more certainty about the direction of the global economy.

In other energy trading, heating oil rose 0.4 cent to $3.04 per gallon and gasoline futures rose 0.6 cent to $2.83 per gallon. Natural gas added 0.2 cents to $2.32 per 1,000 cubic feet.

Oil prices climb on improving US jobs numbers (AP)

Oil prices are climbing after the government said the number of Americans seeking unemployment benefits dropped to its lowest point since April 2008.

Benchmark oil rose 83 cents to $101.42 per barrel Thursday morning in New York. Brent crude rose 83 cents to $111.49 per barrel in London.

The Labor Department says the number of people seeking unemployment benefits fell to 352,000 last week. The news gives investors more confidence that demand for oil and other energy products may grow stronger as more people head back to work.

At the pump, AAA says the national average for gasoline remains at $3.38 a gallon. That's about 17 cents more than a month ago and 27 cents more than a year ago.

After losing Horford, Hawks show surprising grit (AP)

ATLANTA ? When Al Horford tumbled to the court, his hopes of playing again this season all but snuffed out, everyone figured he'd take the Atlanta Hawks down with him.

Well, look who's in first place.

The Hawks (11-4) have won four straight since their All-Star center tore his left pectoral muscle, an injury that required surgery and will keep him out for most if not the entire rest of the season.

A talented but enigmatic team known for buckling under pressure, Atlanta has shown surprising grit and resolve in the wake of Horford's devastating injury.

Granted, all four wins have come at home, and three were against teams with losing records. Still, the Hawks have impressed by managing to hang together, led by Joe Johnson and Josh Smith.

A Q&A on contested Internet anti-piracy bills (AP)

WASHINGTON ? Online piracy costs U.S. copyright owners and producers billions of dollars every year, but legislation in Congress to block foreign Internet thieves and swindlers has met strong resistance from high-tech companies, spotlighted by Wikipedia's protest blackout on Wednesday, warning of a threat to Internet freedom.

House and Senate bills that once seemed to be on a path toward approval now face a rockier future. House Speaker John Boehner on Wednesday said it was "pretty clear to many of us that there is a lack of consensus at this point."

Amid the high-tech campaign against the bills, several lawmakers came out in opposition. At least four Senate Republicans who had previously cosponsored the Senate bill ? Orrin Hatch of Utah, Roy Blunt of Missouri, John Boozman of Arkansas and Charles Grassley of Iowa ? issued statements Wednesday saying they were withdrawing their support. Democratic Sen. Ben Cardin of Maryland last week said that, after listening to constituent concerns, he could not vote for the Senate bill as it is currently written.

On the House side, Rep. Rick Larsen, D-Wash., issued a statement that he had heard from many of his constituents and come to the conclusion that the House and Senate bills "create unacceptable threats to free speech and free access to the Internet."

Here are some of the some of the questions being raised about the bills being considered:

Q. Why is legislation needed?

A. There's no argument that more needs to be done to protect artists, innovators and industries from copyright thieves and shield consumers from products sold on the Internet that are fake, faulty and unsafe. Creative America, a coalition of Hollywood studios, networks and unions, says content theft costs U.S. workers $5.5 billion a year. The pharmaceutical industry loses billions to Internet sellers of drugs that are falsely advertised and may be harmful.

Q. What is Congress trying to accomplish?

A. The two main bills are the Protect Intellectual Property Act, or PIPA, in the Senate, and the similar Stop Online Privacy Act, or SOPA, in the House. There are already laws on the books to combat domestic websites trafficking in counterfeit or pirated goods, but little to counter foreign violators.

The bills would allow the Justice Department, and copyright holders, to seek court orders against foreign websites accused of perpetrating or facilitating copyright infringement. While there is little the United States can do to take down those websites, the bills would bar online advertising networks and payment facilitators such as credit card companies and PayPal from doing business with an alleged violator. It also would forbid search engines from linking to such sites.

The original bills would have let copyright holders and Internet service providers block access to pirate websites. Critics and Internet engineers complained that would allow copyright holders to interfere in the behind-the-scenes system that seamlessly directs computer users to websites. They said that causing deliberate failures in the lookup system to prevent visits to pirate websites could more easily allow hackers to trick users into inadvertently visiting websites that could infect their computers. The White House also took issue with that approach, saying "We must avoid creating new cybersecurity risks or disrupting the underlying architecture of the Internet."

Responding to the critics, House Judiciary Committee Chairman Lamar Smith, R-Texas, said he is taking the blocking measure out of his bill. Senate Judiciary Committee Chairman Patrick Leahy, D-Vt., also is reworking his bill to address those cybersecurity issues.

Q. What are other concerns with the bills?

A. Critics say they would constrain free speech, curtail innovation and discourage new digital distribution methods. NetCoalition, a group of leading Internet and technology companies, says they could be forced to pre-screen all user comments, pictures and videos ? effectively killing social media. Search engines, Internet service providers and social networks could be forced shut down websites linked to any type of pirated content.

In addition, critics contend that young, developing businesses and smaller websites could be saddled with expensive litigation costs. And, they contend existing rights holders could impede new investment in the technology sector.

The White House said it would "not support any legislation that reduces freedom of expression ... or undermines the dynamic, innovative global Internet."

Leahy responded that there is nothing in the legislation that would require websites, Internet service providers, search engines, ad networks, payment processors or others to monitor their networks. He said his bill protects third parties from liability that may arise from actions to comply with a court order.

Michael O'Leary, a senior vice president at the Motion Picture Association of America, a key supporter of the legislation, said his industry is built upon a vibrant First Amendment. "We would never support any legislation that would limit this fundamental American right," he said. Neither PIPA nor SOPA "implicate free expression but focus solely on illegal conduct, which is not free speech."

Q. Who else supports the bills?

A. The most visible supporters are entertainment-related groups such as the MPAA and the National Music Publishers' Association. But the bills also enjoy support from the pharmaceutical industry, which is trying to shut down illegal online drug operations, and electronic and auto industries concerned about people going online to buy counterfeit parts that may be substandard. The U.S. Chamber of Commerce and several law enforcement groups also back the legislation.

Q. Who are the opponents?

A. In addition to Wikipedia, many major Internet and technology companies, including Google, Yahoo!, Amazon.com and eBay, are part of the NetCoalition group opposing the bills. Disparate political groups such as the liberal Democracy for America and the conservative Heritage Action have also voiced concerns about censorship.

Q. What is the status of the bills?

A. Momentum for the bills has slowed, giving the edge to Silicon Valley over Hollywood. The Senate, as its first major business when it returns to session next Tuesday, is to vote on whether to take up the bill. Sixty votes are needed to clear that legislative hurdle. It's unclear whether supporters have the votes.

Six Republicans on the Judiciary Committee last week wrote Majority Leader Harry Reid, D-Nev., saying that while the problem of intellectual property theft must be addressed, "the process at this point is moving too quickly" and a vote on moving to the bill "may be premature."

Reid replied that the vote will occur as scheduled, saying that while the bill was not perfect and he had urged Leahy to make changes, the issue was "too important to delay."

In the House, Judiciary Committee Chairman Smith said his panel would resume deliberations on SOPA in February. Meanwhile, Rep. Darrell Issa, R-Calif., chairman of the House Oversight and Government Reform Committee and an ally of the high-tech industry, said he had received assurances from GOP leaders that anti-piracy legislation would not move to the House floor this year unless there is a consensus on it.

Issa, and Sen. Ron Wyden, D-Ore., are pushing an alternative to SOPA and PIPA that would make the International Trade Commission, which already is in charge of patent infringements, responsible for taking steps to prevent money and advertising from going to rogue sites.

Issa formally introduced his bill Wednesday, saying the Internet blackout had "underscored the flawed approach taken by SOPA and PIPA" and his bill was "a smarter way to protect taxpayers' rights while protecting the Internet."

Guatemala president: Mexican gang seeks control (AP)

MEXICO CITY ? Guatemala's newly inaugurated president says Mexico's Zetas drug cartel sought to take over the drug trade in Guatemala by co-opting or killing local traffickers.

President Otto Perez says the Zetas offered deals for gangs willing to form part of their network, and killed those who refused.

The Zetas have been blamed for Guatemala's biggest drug-related massacre, the slaughter of 27 cattle ranch workers in May.

Perez says he is seeking to verify reports from ex-President Alvaro Colom that rival drug lord Joaquin "El Chapo" Guzman has been in Guatemala.

Perez told the Mexican television network Televisa Monday that the Zetas started moving into Guatemala about four years ago.

U.S., Russia arms negotiators plan stability talks (Reuters)

WASHINGTON (Reuters) ? U.S. and Russian negotiators will hold talks this year on issues ranging from missile defense to cyber security, hoping to set the stage for a renewed arms control push once elections are over in both countries, the top U.S. arms negotiator said on Thursday.

Ellen Tauscher, undersecretary of state for arms control, said a year after the New START nuclear arms treaty with Russia that the United States was still committed to returning to the negotiating table to discuss cuts in strategic and tactical nuclear weapons.

But with Europe working on a nuclear deterrence review, elections in Russia and the United States, and Moscow largely satisfied with nuclear stockpile levels following the New START treaty, Tauscher said the timing was not right for a new round of nuclear talks.

"We would like to get back to talks ... but I think we're sanguine about the fact that they're not ready to do it," she told defense writers. "So what we've decided to do is to multitask and to use this next six to eight months to do these ... strategic stability talks."

Tauscher, who would lead the talks with her Russian counterpart, said the two sides agreed in December to focus on 13 topic areas and to meet at least monthly and talk every few days in an effort to identify common concerns, threats and points of agreement.

The issues include conventional forces in Europe, piracy, cyber security, missile defense and other areas where there is a considerable amount of common interest and agreement but some threat as well. The aim is to define what the two sides mean by strategic stability and what steps they must take to achieve it.

"We're not wasting this year, which is pretty much consumed by ... things that are going to distract people," Tauscher said. "We'll get that work done, and as soon as we get the opening subsequent to their election and perhaps even subsequent to ours, off we go."

Tauscher said the New START treaty ratified last February had been an important step in improving U.S. and Russian relations, which had soured as a result of U.S. efforts to build a missile defense system in Europe and other disagreements.

The accord commits both sides to reduce their deployed nuclear warheads to no more than 1,550 within seven years. While the reduction was modest, the treaty revived much of the inspection and verification system of the original START strategic arms treaty.

The United States has signaled an interest in further nuclear cuts, in part to cut costs. A strategic review released last week to help guide spending reductions at the Pentagon said it was possible that U.S. deterrence goals could be achieved with a smaller nuclear arsenal.

The review was guided by conclusions in a near-complete Pentagon study on how to implement the administration's 2010 Nuclear Posture Review. The classified document also makes recommendations about changes that should be made in future nuclear policy.

'HEDGE WEAPONS'

U.S. President Barack Obama has endorsed a long-term goal of eliminating nuclear weapons, while seeking $80 billion over 10 years to revitalize the nation's nuclear weapons complex to provide confidence the aging arsenal will work.

Tauscher said the spending was a necessary part of achieving deeper cuts in the U.S. nuclear stockpile because it would give Washington the confidence it needed to eliminate many of its underplayed warheads, which are kept as a hedge in case some weapons do not work.

"As you take weapons down, mostly you're probably going to take down what we call the hedge weapons first," she said. "You have to have a responsive infrastructure to do that."

While ties with Moscow have improved as a result of the New START treaty, the Obama administration's effort to build a missile defense system in Europe continues to be a source of friction in the relationship, Tauscher said.

After he took office in 2009, Obama abandoned former President George W. Bush's plan for a European missile defense shield and replaced it with the so-called phased adaptive approach.

The Obama system relied on smaller missile interceptors initially based on ship and later on the ground in Poland and Romania along with a radar system in Turkey.

Washington says the system is aimed at countering a missile threat from Iran, but Russia is concerned it could be used to undermine Moscow's nuclear deterrent. Russia has demanded assurances that Tauscher said the United States could not give without limiting or eliminating parts of the system.

"The only way they're going to be reassured that ... the system itself does not undercut their strategic deterrent is to sit with us in the tent in NATO and see what we're doing," she said.

"So is it a political leap of faith? Yes. Are they ready to do it? No," she said. "But we're hoping that these strategic stability talks over the next eight months will start to kind of loosen these old ties that have been binding everybody."

Delhaize to cut almost 5,000 jobs in US (AP)

BRUSSELS ? A Belgian supermarket chain that owns Food Lion said Thursday it will close more than 100 struggling stores, mostly in Florida, Georgia, South Carolina and Tennessee.

The company will also shutter the Bloom brand, a sister grocery chain that had been launched as a higher-end alternative to Food Lion.

Pierre-Olivier Beckers, CEO of Delhaize Group, said in a statement the company was dealing with tight consumer spending and increased competition. He said that the store closings, most of which will come in markets where the company has a low penetration, will allow it to focus on better-performing stores where the chain has greater market share.

The store closings will result in about 4,900 job cuts in the U.S., the company said. Beckers said the decisions were difficult but "were in keeping with our responsibility to our shareholders to deploy resources where they will achieve the highest return."

Delhaize will close 113 Food Lion stores in Florida, Georgia, Kentucky, North Carolina, Pennsylvania, South Carolina, Tennessee, Virginia and West Virginia. It will close seven Bloom stores in Maryland and Virginia, and convert the remaining 42 Bloom stores to Food Lions.

It will also close six Bottom Dollar Food stores in North Carolina and Virginia, and convert 22 others into Food Lions. A distribution center located in Tennessee will also be closed.

But while Delhaize is retiring the Bloom brand, it says it sees promise for Bottom Dollar Food. It said the chain had enjoyed "considerable success" in the Philadelphia area, and that it planned to open its first stores in the Pittsburgh area early this year. Delhaize also reiterated that it plans to add "hundreds" of Bottom Dollar Food stores in the next five years.

Delhaize has about 1,650 stores in the Eastern U.S.

Chinese visitors bring a happy new year to Cairns

THE Far North is gearing for a tourism bonanza with Chinese New Year celebrations in two weeks.

At least 16,000 Chinese visitors are expected in the region from about January 20.

Many have already arrived to visit relatives and friends and are extending their holidays to include the Chinese New Year on January 23.

Cairns Airport chief executive Kevin Brown said double the number of Chinese New Year flights would arrive in 2012, compared with 2011.

"We have a total of 12 additional flights coming direct from China to Cairns," he said.

"There are seven China Southern flights from Guangzhou and three China Eastern flights from?Shanghai.

"Cathay Pacific has added two extra flights from Hong Kong in addition to their daily Hong Kong-Cairns service.

"The charter flights will have the capacity to bring almost 4000 visitors into Cairns plus there are many thousands more expected to arrive via domestic services for a total of about 16,000."

The first charter flight is expected on January 21 and the last on January 28.

Tourism Tropical North Queensland consumer marketing director David Inches said the Chinese New Year was "a major business boost to start 2012 and places Cairns on the front foot for the year ahead".

"The doubling of visitors on last year shows we are right on track in building our relationships with the Chinese carriers, trade and travellers," he said.

Harry Sou of Cafe China said this year?s Chinese New Year was "shaping up to be the best and biggest".

"Apart from the 12 charters, a lot of Chinese come here on domestic services," he said.

Mr Sou said many restaurants, hotels and tourism operators would benefit.

He said many Chinese visitors had extended their Far Northern holidays to include the new year, because schools and universities did not resume until the end of January.

The highlight of the Chinese New Year in Cairns is the street festival on the Cairns Esplanade on January 21 from 3pm.

Spending on business travel to increase in 2012

If you want an indication of where the economy is going, look for business travelers the next time you fly or check into a hotel.

The more companies spend on business travel, the more likely the economy is inching closer to a recovery, and a new report hints at that very possibility for 2012.

On Tuesday, the Global Business Travel Association (GBTA) released its latest Business Travel Quarterly Outlook, which monitors business travel spending among U.S. companies. According to the report, spending on business travel is expected to top $263 billion dollars this year, an increase of 4.6 percent over last year.

?We?ve hit the reset button from pre-recession levels,? said Michael McCormick, executive director and chief operating officer. ?We?re back at the level we were at in 2007.?

Alas, it?s not all good news as most of the increase is expected to come from rising travel costs rather than an increase in the number of trips taken. While the number of trips business travelers took in 2011 was up 2.1 percent over the year before, GBTA predicts they?ll post a slight decline of 0.8 percent this year.

Nevertheless, says McCormick, the fact that businesses are spending money on travel is itself a positive sign ? not just for businesses but for the travel industry and the nation.

?Business travelers are a big driver of the economy,? he told msnbc.com. ?The amount of revenue dollars and tax dollars that are created by business travelers being out there is a great way to measure the health of the economy.??

Recent research from Deloitte LLP provides some cause for optimism. In September, the market research and consulting company conducted a survey of 1,000 business travelers and 85 percent of respondents said they expected to take the same number or more trips in 2012 than in 2011.

According to Adam Weissenberg, vice chairman of global travel, hospitality and leisure at Deloitte LLP, much of that bullishness can be traced to Gen X and Gen Y business travelers. While only 16 percent of respondents ages 45 and older are planning more trips this year, 27 percent of those between 18 and 44 expect to travel for work.

?Gen X and Gen Y travelers are making up more of the workforce and they?re also more optimistic,? said Weissenberg. Furthermore, their influence is becoming increasingly apparent, he told msnbc.com, as hotels renovate formal lobbies into friendlier, social venues; airlines offer more online and mobile services; and more ?lifestyle? restaurants offer a middle ground between fast-food and waiter service.

Such changes, of course, won?t happen overnight, just as the improving economy is proving to be a slow-motion affair. In the meantime, both McCormick and Weissenberg maintain that as business travel goes, so goes the larger economy ? at least eventually.

?There?s typically a lag between business travel and the economy,? said Weissenberg. ?Historically, heading into a recession, [the drop in] business travel is about six months behind because people have already booked plane tickets, set up meetings, paid fees for conferences. That doesn?t change overnight.?

Conversely, as companies begin to see signs of economic growth, they gradually become more optimistic to the point that they start sending people back out on the road. According to GBTA, business travel typically lags the economy by a quarter (of a four-quarter year), which suggests the effects of that optimism will start to show up this spring or summer.

?What we?re seeing now is that 2012 is looking better than 2011,? said Weissenberg. "Clearly, it?s a good sign.?
