New order found in quantum electronic material: May lead to new materials, magnets and superconductors

Jan. 30, 2013 ? Two Rutgers physics professors have proposed an explanation for a new type of order, or symmetry, in an exotic material made with uranium -- a theory that may one day lead to enhanced computer displays and data storage systems and more powerful superconducting magnets for medical imaging and levitating high-speed trains.

Their discovery, published in this week's issue of the journal Nature, has piqued the interest of scientists worldwide. It is one of the rare theory-only papers that this selective publication accepts.

Collaborating with the Rutgers professors was a postdoctoral researcher at Massachusetts Institute of Technology (MIT) who earned her doctorate at Rutgers.

"Scientists have seen this behavior for 25 years, but it has eluded explanation." said Piers Coleman, professor in the Department of Physics and Astronomy in the School of Arts and Sciences. When cooled to 17.5 degrees above absolute zero or lower (a bone-chilling minus 428 degrees Fahrenheit), the flow of electricity through this material changes subtly.

The material essentially acts like an electronic version of polarized sunglasses, he explains. Electrons behave like tiny magnets, and normally these magnets can point in any direction. But when they flow through this cooled material, they come out with their magnetic fields aligned with the material's main crystal axis.

This effect, claims Coleman, comes from a new type of hidden order, or symmetry, in this material's magnetic and electronic properties. Changes in order are what make liquid crystals, magnetic materials and superconductors work and perform useful functions.

"Our quest to understand new types of order is a vital part of understanding how materials can be developed to benefit the world around us," he said.

Similar discoveries have led to technologies such as liquid crystal displays, which are now ubiquitous in flat-screen TVs, computers and smart phones, although the scientists are quick to acknowledge that their theoretical discovery won't transform high-tech products overnight.

Coleman, along with Rutgers colleague Premala Chandra and MIT collaborator Rebecca Flint, describe what they call a "hidden order" in this compound of uranium, ruthenium and silicon. Uranium is commonly known for being nuclear reactor fuel or weapons material, but in this case physicists value it as a heavy metal with electrons that behave differently than those in common metals.

Recent experiments on the material at the National High Magnetic Field Laboratory at Los Alamos National Laboratory in New Mexico provided the three physicists with data to refine their discovery.

"We've dubbed our fundamental new order 'hastatic' order, named after the Greek word for spear," said Chandra, also a professor in the Department of Physics and Astronomy. The name reflects the highly ordered properties of the material and its effect on aligning electrons that flow through it.

"This new category of order may open the world to new kinds of materials, magnets, superconductors and states of matter with properties yet unknown," she said. The scientists have predicted other instances where hastatic order may show up, and physicists are beginning to test for it.

The scientists' work was funded by the National Science Foundation and the Simons Foundation. Flint is a Simons Postdoctoral Fellow in physics at MIT.

Clinton doesn't see 'getting back into politics'

WASHINGTON (Reuters) - Outgoing U.S. Secretary of State Hillary Clinton on Tuesday cast doubt on speculation she might run for the White House in 2016.

In an interview taped for National Public Radio, Clinton was asked what questions she needs to answer for herself as she decides whether to run for president.

"I'm not even posing those questions. I am really looking forward to stepping off the fast track that I've been on. I've been out of politics as Secretary of State. I don't see myself getting back into politics," she said, according to an excerpt of the interview.

Whether this is her last word on the subject is unknown. She will face strong pressure from Democrats to join the field of contenders. Clinton will step down this week, following Senate confirmation Tuesday of Massachusetts Democratic Senator John Kerry as her successor.

Those close to Clinton are eager for her to announce a 2016 run, so much so that a group has already formed a new super PAC and registered with the Federal Election Commission on Friday, called "Ready for Hillary."

In 2008, she lost to President Barack Obama in a bitter Democratic primary campaign to be the party nominee for the White House.

Although Clinton, 65, did not categorically rule out another presidential run, in a separate NBC interview she said that she was healthy enough to wage a campaign.

"I have no doubt that I am healthy enough and my stamina is great enough and I'll be fully recovered to do whatever I choose to do," Clinton told "Andrea Mitchell Reports" in an interview that aired on Tuesday.

Clinton was hospitalized in December after doctors found a blood clot stemming from a concussion she suffered previously.

She intends to do more public speaking and writing, and work alongside her husband, former President Bill Clinton, and daughter Chelsea on "mutual foundation interests," she said in the NPR interview.

"I want to be involved in philanthropy, advocacy, working on issues - like women and girls - that I care deeply about," Clinton said.

Officials at the Dale County Sheriff's Department could not be immediately reached for comment on the incident in Midland City, but they put out a brief statement saying a command post had been set up near the site where the suspected shooter was barricaded.

The Dothan Eagle newspaper said the gunman was in a bunker near his home hours after the shooting, but that it was not clear if the child taken from the bus was also in the bunker.

The shooting comes as the nation is on edge about gun violence, especially in schools, after a gunman shot dead 20 students and six staff members at a Connecticut elementary school last month, stoking a national debate on gun control.

The sheriff's department said multiple agencies were assisting with the incident and local area schools would be closed on Wednesday. It gave no further details.

The three main areas of VOIP are: Business or Hosted VOIP, VOIP based Business Telephone Systems and Consumer VOIP.

1. Business VOIP services such as hosted PBX ? A hosted PBX is a telephone system that is housed outside of the customer?s office in the provider?s network and is becoming popular in the work place. The customer uses an Internet connection and VOIP telephones connected to their local area network. The advantage of these services can be a fixed cost per month with unlimited calls, as well as using the same telephone system for employees with common voice mail and dialing plans.

The disadvantage of these services can be service outages caused by the customer?s local area network, the Internet connection, or the hosted PBX provider. It is also often difficult to diagnose the source of the service outages, resulting in frustration for the customer and service provider. The highest-quality hosted PBX providers will provide their own Internet connection and often insist on managing the customer?s local area network so they can make sure that service works properly. Some customers save money with hosted PBX but many do not due to the cost of local area network upgrades. These systems need to be looked at on a case by case basis.

2. VOIP based business telephone systems ? These systems place the telephone hardware at the customer?s office. The features are very similar to a hosted PBX and the telephone lines can be VOIP based (called SIP trunks) or traditional telephone lines. The initial cost of these systems is often 20 to 50% higher than a traditional telephone system but there are long term savings on maintenance. For example; employees can simply plug their phone into any network jack in the office. There is often a requirement for upgrade or replacement of the local area network equipment for these systems to function properly.

VOIP based business telephone systems are growing rapidly in business telecommunications and there is no question that this trend will continue. In spite of the popularity there are many customers who have experienced significant service interruptions due to poorly planned installations. Even the best installations do tend to have a higher incidence of occasional unexplained technical problems. It is highly recommended that business installations be handled by a trained professional with a past record of successful installations. Make sure that thorough reference checks are performed on any vendors before the project is implemented, and that the system is fully tested under real life conditions before the installers leave the building.

3. Consumer VOIP services ? These are free or low cost services such as Skype, Vonage, or Google Voice. Typically, these are used for saving money on long distance telephone calls.? These services are especially popular for placing international calls. Skype is also used as a video conferencing service. These services often do save money but the quality of calls can vary since the provider has no control over the user?s Internet connection. If you can tolerate poor connection quality or can place another call over a regular telephone line when VOIP call quality is poor, this service may be of interest to you.?

These services do work especially well for businesses to save money when an employee is located in another country. The amount of money saved is usually significant compared to buying traditional telephone service.? However, most businesses telephone conversations are important and the cost of lost calls or poor communication can far outweigh the savings. Long distance calling rates have come down significantly in the past few years, so a regular telephone line may end up being a better option even for international calls.

Genes behind aggressive endometrial cancer

Jan. 28, 2013 ? In a major breakthrough for uterine serous carcinoma (USC) -- a chemo-resistant, aggressive form of endometrial cancer, Yale researchers have defined the genetic landscape of USC tumors, findings that point to new treatment opportunities.

The collaborative team -- which included researchers with expertise in gynecological cancer, genomics, and computational biology -- identified a number of new genes that are frequently mutated in USC. The results of this comprehensive genetic analysis of USC are published in the Jan. 28 Proceedings of the National Academy of Science (PNAS) online early edition. The researchers were supported as part of a collaborative program with Gilead Sciences, Inc.

Endometrial cancer is the most prevalent gynecologic tumor in women, with over 47,000 newly diagnosed cases and about 8,000 deaths in 2012 in the United States alone. Patients with type I endometrial cancer tumors generally have a good outcome, but those with type II, or USC, have more relapses and deaths, and the disease is more aggressive.

"We have clearly identified the mutations that are responsible for USC tumors," said senior author of the study Dr. Alessandro Santin, professor of obstetrics, gynecology and reproductive sciences at Yale School of Medicine, and program leader of the gynecological cancers research program at Smilow Cancer Hospital at Yale-New Haven and a member of Yale Cancer Center. "In addition to a number of well-known cancer genes, we found three genes that had not previously been associated with cancer that are found in these tumors. This finding points to new pathways that could be important in developing therapies down the road."

The team collected tumors from 57 women affected with USC to try to determine the molecular basis of the tumor's aggressive behavior. They sequenced all the genes from the tumors and identified mutations that are crucial for these tumors to grow. The team also studied the copy number variations -- genes that are not mutated but are amplified in the tumors to give them a growth advantage over normal tissues.

The newly-identified cancer-related genes included two -- CHD4 and MBD3 -- that are found in the same protein complex and play a role in remodeling the genome to allow certain regions to be turned on and off. The discovery of a third gene, TAF1, was a surprise to researchers because it is a core component of the machinery responsible for transcribing a large fraction of the protein coding genes in the human genome.

"The detailed study of different cancers continues to produce new and unexpected discoveries," said corresponding author Dr. Richard P. Lifton, Sterling Professor, chair of genetics at Yale, and a Howard Hughes Medical Institute investigator. "These new findings define the biological basis of this cancer, and suggest new opportunities for personalized therapy."

Majority of Americans support dozens of policies to strengthen U.S. gun laws

Jan. 28, 2013 ? The majority of Americans support a broad array of policies to reduce gun violence, according to a new national public opinion survey conducted by researchers at the Johns Hopkins Bloomberg School of Public Health. These policies include: requiring universal background checks for all gun sales (supported by 89 percent); banning the sale of military-style semiautomatic assault weapons (69 percent); banning the sale of large-capacity ammunition magazines (68 percent); and prohibiting high-risk individuals from having guns, including those convicted of a serious crime as a juvenile (83 percent) and those convicted of violating a domestic-violence restraining order (81 percent). Americans also support a range of measures to strengthen oversight of gun dealers and various policies restricting gun access by persons with mental illness.

The national survey, which over-sampled gun owners and non-gun owners living in homes with guns to allow for more precise estimates of opinions among these groups, was fielded in January, 2013, several weeks following the mass school shooting in Newtown, Connecticut. The majority of Americans support all but 4 of the 31 gun policies asked about in the survey. For many policies, there was little difference in support between gun owners and non-gun-owners.

"This research indicates high support among Americans, including gun owners in many cases, for a wide range of policies aimed at reducing gun violence," said lead study author Colleen Barry, PhD, MPP, an associate professor at the Johns Hopkins Bloomberg School of Public Health. "These data indicate broad consensus among the American public in support of a comprehensive approach to reducing the staggering toll of gun violence in the United States."

At the same time, the researchers fielded a second national survey to assess Americans' attitudes about mental illness. This survey reveals ambivalent attitudes among the American public about mental illness. Sixty-one percent of respondents favor greater spending on mental health screening and treatment as a strategy for reducing gun violence, and 58 percent said discrimination against people with mental illness is a serious problem. Yet, almost half of respondents thought people with serious mental illness are more dangerous than others, and two-thirds expressed unwillingness to have a person with a serious mental illness as a neighbor.

"In light of our findings about Americans' attitudes toward persons with mental illness, it is worth thinking carefully about how to implement effective gun-violence-prevention measures without exacerbating stigma or discouraging people from seeking treatment," added Barry.

The results of both surveys are summarized in "After Newtown -- Public Opinion on Gun Policy and Mental Illness," published online on January 28th in The New England Journal of Medicine.

Gun violence claims 31,000 U.S. lives each year in the U.S., and the rate of firearms homicides in America is 20 times higher than it is in other economically advanced nations.

Johns Hopkins researchers conducted this study using the survey research firm GfK Knowledge Networks. There were 2,703 respondents in the gun policy survey and 1,530 respondents in the mental illness survey.

"Not only are gun owners and non-gun-owners very much aligned in their support for proposals to strengthen U.S. gun laws," said co-author Daniel Webster, ScD, MPH, director of the Johns Hopkins Center for Gun Policy and Research, "but the majority of NRA members are also in favor of many of these policies."

The survey found that 74 percent of NRA members support requiring universal background checks for all gun sales; 64 percent of NRA members support prohibiting people who have been convicted of two or more crimes involving alcohol or drugs within a 3-year period from having a gun, and 70 percent of NRA members want a mandatory minimum sentence of 2 years in prison for a person convicted of knowingly selling a gun to someone who is not legally allowed to own one.

"These data indicate that the majority of Americans are in favor of policy changes that would ultimately increase safety," said Jon Vernick, JD, MPH, co-director of the Johns Hopkins Center for Gun Policy and Research and a co-author of the study. "This consensus should propel forward comprehensive legislation aimed at saving lives."

Hydrogen sulfide: The next anti-aging agent?

Jan. 29, 2013 ? Hydrogen sulfide* (H2S) may play a wide-ranging role in staving off aging, according to a paper published online ahead of print in the journal Molecular and Cellular Biology. In this review article, a team from China explores the compound's plethora of potential anti-aging pathways.

"H2S has been gaining increasing attention as an important endogenous signaling molecule because of its significant effects on the cardiovascular and nervous systems," the team writes. The evidence is mounting, they note, that hydrogen sulfide slows aging by inhibiting free-radical reactions, by activating SIRT1, an enzyme believed to be a regulator of lifespan, and probably through its interactions with a gene, klotho, which appears to have its own market basket of anti-aging activity.

Hydrogen sulfide is produced within the human body, and has a variety of important physiological effects. For example, it relaxes the vascular endothelium and smooth muscle cells, which is important to maintaining clean arteries as one ages, says first author Zhi-Sheng Jiang, of the University of South China, Hunan. It functions as an antioxidant. And it inhibits expression of pro-inflammatory factors, all of which "imply an important role in aging and age-associated diseases," according to the paper. For example, mice lacking CSE, the gene for an enzyme involved in producing H2S, manifest extensive, premature arteriosclerosis, an inevitable consequence of aging, says Jiang.

The gene, klotho, which appears to be upregulated by hydrogen sulfide, is thought to extend lifespan via a number of different pathways, some of which promote production of endogenous antioxidants, according to the report. Produced in the kidneys, it has direct angiotensin-converting enzyme (ACE) inhibiting activity; that is, it's an ACE inhibitor, just like certain drugs that mitigate high blood pressure. Not surprisingly, plasma H2S declines with age, and is lower in spontaneously hypertensive rats than in those with normal blood pressure. More generally, a lack of H2S is implicated in cardiovascular disease.

A decline in H2S is also thought to undermine neurological health. Endogenous H2S has been found wanting in an animal model of Parkinson's disease, and is found to be depressed in the brains of patients with Alzheimer's disease. There are even suggestions, mostly in animal models, but also in human studies, that H2S may be protective against cancer, according to the report.

"Data available so far strongly suggest that H2S may become the next potent agent for preventing and ameliorating the symptoms of aging and age-associated diseases," concludes Jiang. In the future, he says, people may take H2S via food, or as an anti-aging supplement.

(AP) ? Humbled a year ago when both its cars failed to make the podium, Chip Ganassi Racing returned to the Rolex 24 at Daytona determined to pick up another victory watch.

An eyebrow-raising lineup change that involved Juan Pablo Montoya showed just how serious the team was about winning, and it delivered Sunday with its fifth win in 10 appearances in the prestigious sports car race. The victory was the fifth for lead driver Scott Pruett, tying Hurley Haywood's record for wins in the twice-around-the-clock race at Daytona International Speedway.

The winning team of three-time defending Grand-Am drivers Pruett and Memo Rojas, along with Montoya and IndyCar driver Charlie Kimball, making his Rolex debut, beat the Max Angelelli-led VelocityWW team by almost 22 seconds for the victory.

It was Montoya who closed out the win, driving the final stint and waging a strong battle in the final hour with defending champion AJ Allmendinger. Ganassi's No. 01 BMW Riley had a clear horsepower advantage, and once Montoya got past Allmendinger, the win was his for the taking.

But the Ganassi team figured it was four laps short on fuel, and Montoya needed to build a lead of at least 40-seconds to hold off Angelelli and Allmendinger when he was forced to stop for gas. The Colombian did it by turning laps close to qualifying pace, and breezed to his third Rolex victory.

Montoya's other two wins were with Pruett on the No. 01 car in 2007 and 2008, but he spent the last three years driving for the No. 02 Ganassi "star car" and came away empty-handed each time. When the Ganassi cars were left off the Rolex podium last season for the first time since 2005, team management went to work on the cars and setting up a lineup that gave them two chances to win.

Montoya admitted he thought the switch was "a weird move," but owner Chip Ganassi and team manager Mike Hull insisted it wasn't a demotion for the driver who has been stuck in a lengthy slump in his full-time NASCAR job.

Clearly the pressure is on Montoya to perform this year, the final year of his contract with Ganassi, and he stepped up Saturday and Sunday as the No. 01 team had to balance out Kimball's inexperience. It was the first time racing in a car with a roof on it for Kimball, who has diabetes and uses his fight with the disease as his platform.

The Chevrolet team of Angelelli, defending IndyCar champion Ryan Hunter-Reay and Jordan Taylor finished second for team owner Wayne Taylor ? redemption after an engine failure 22 minutes in last year's event ended the team's day.

Defending race winner Michael Shank Racing twice came back from seven laps down to finish third in a Ford. It was a disappointing finish for team owner Shank, but a moral victory considering the hole the team clawed out of to make it to the podium.

Allmendinger, racing at Daytona for the first time since NASCAR suspended him for failing a random drug test hours before the July race here, teamed with fellow NASCAR driver Marcos Ambrose, IndyCar driver Justin Wilson and Grand-Am regulars John Pew and Ozz Negri for the finish.

Ambrose was added to last year's winning lineup after Negri broke his leg a month ago during offseason training, but Negri was able to return to the car this weekend for limited driving duties a mere six days after his cast was removed.

Audi Sport Customer Racing won the GT class in an Audi R8 with drivers Filipe Albuquergue, Oliver Jarvis, Edoardo Mortara and Dion von Moltke.

Oil rises above $96 ahead of US data

BANGKOK (AP) ? The price of oil rose slightly Monday, a sign of investor confidence in the U.S. economy's recovery ahead of the release of data on jobs, home sales and the country's overall growth.

Benchmark oil for March delivery was up 14 cents to $96.02 per barrel at midday Bangkok time in electronic trading on the New York Mercantile Exchange. The contract fell 7 cents to close at $95.88 on the Nymex on Friday after a report showed a cooling off in new U.S. home sales.

The U.S. government will release monthly durable goods figures later Monday, and the National Association of Realtors will report on pending home sales for December. Later in the week, reports on weekly jobless claims and employment data for January are due.

Analysts expect to see continuing signs of a sluggish recovery, even amid lowered expectations for fourth-quarter economic growth for 2012, to be released by the U.S. Commerce Department on Wednesday.

"If 4Q growth comes in at the 1.5 percent we expect, it will have averaged 2 percent over the past four quarters ... Slow and steady is the name of the game," analysts at DBS Bank Ltd. in Singapore said in a market commentary.

Brent crude, used to price international varieties of oil, fell 10 cents to $113.18 per barrel on the ICE Futures exchange in London.

In other energy futures trading on Nymex:

? Wholesale gasoline fell 0.7 cent to $2.883 per gallon.

? Natural gas fell 5.3 cents at $3.391 per 1,000 cubic feet.

? Heating oil rose 0.2 cent to $3.051 a gallon.

Of course, cold emailing was a necessary part of the process, but we also spent time searching for the social media platforms managed by the schools. These days, most schools have well-maintained Twitter accounts and Facebook profiles. (Many also have blogs; some even have several blogs for different departments within the institution.)

As any online marking professional knows, social media is crucial for almost every online promotional campaign. My team has been working to connect with schools via any social media outlet available. In the past, social media was an overlooked component of our online marketing campaigns, but this isn?t the case anymore. We were able to get the word out about the scholarship program not only via traditional but also non-traditional methods.

(AP) ? President Barack Obama violated the Constitution when he bypassed the Senate last year to appoint three members of the National Labor Relations Board, a federal appeals court ruled Friday in a far-reaching decision that could severely limit a chief executive's powers to make recess appointments.

The decision of the U.S. Court of Appeals for the D.C. Circuit marked a victory for Republicans and business groups critical of the labor board. If it stands, it could invalidate hundreds of board decisions over the past year, including some that make it easier for unions to organize.

When Obama filled the vacancies on Jan. 4, 2012, Congress was on an extended holiday break. But GOP lawmakers gaveled in for a few minutes every three days just to prevent Obama from making recess appointments. The White House argued that the pro forma sessions ? some lasting less than a minute ? were a sham.

The court rejected that argument, but went even further, finding that under the Constitution, a recess occurs only during the breaks between formal year-long sessions of Congress, not just any informal break when lawmakers leave town. It also held that presidents can bypass the Senate only when administration vacancies occur during a recess.

White House press secretary Jay Carney said the administration strongly disagrees with the decision and that the labor board would continue to conduct business as usual, despite calls by some Republicans for the board members to resign.

"The decision is novel and unprecedented," Carney said. "It contradicts 150 years of practice by Democratic and Republican administrations."

Under the court's decision, 285 recess appointments made by presidents between 1867 and 2004 would be invalid.

The Justice Department hinted that the administration would ask the Supreme Court to overturn the decision, which was rendered by three conservative judges appointed by Republican presidents. "We disagree with the court's ruling and believe that the president's recess appointments are constitutionally sound," the statement said.

The court acknowledged that the ruling conflicts with what some other federal appeals courts have held about when recess appointments are valid, which only added to the likelihood of an appeal to the high court.

"I think this is a very important decision about the separation of powers," said Carl Tobias, a constitutional law professor at Virginia's University of Richmond. "The court's reading has limited the president's ability to counter the obstruction of appointments by a minority in the Senate that has been pretty egregious in the Obama administration."

The ruling also threw into question the legitimacy of Obama's recess appointment of Richard Cordray to head the Consumer Financial Protection Bureau. Cordray's appointment, made on the same date, has been challenged in a separate case.

Carney insisted the court's ruling affects only a single case before the labor board and would have no bearing on Cordray's appointment. Obama on Thursday renominated Cordray for the job.

The case challenging the recess appointments was brought by Noel Canning, a Washington state bottling company that claimed an NLRB decision against it was not valid because the board members were not properly appointed. The D.C. Circuit panel agreed.

Obama made the recess appointments after Senate Republicans blocked his choices for an agency they contended was biased in favor of unions. Obama claims he acted properly because the Senate was away for the holidays on a 20-day recess. The Constitution allows for such appointments without Senate approval when Congress is in recess.

But during that time, GOP lawmakers argued, the Senate technically had stayed in session because it was gaveled in and out every few days for so-called pro forma sessions.

GOP lawmakers used the tactic ? as Democrats had done in the past ? specifically to prevent the president from using his recess power to install members to the labor board and the consumer board. They had also vigorously opposed the nomination of Cordray.

The three-judge panel flatly rejected arguments from the Justice Department's Office of Legal Counsel, which claimed that the president has discretion to decide that the Senate is unavailable to perform its advice and consent function.

"Allowing the president to define the scope of his own appointment power would eviscerate the Constitution's separation of powers," Chief Judge David Sentelle wrote in the 46-page ruling. He was appointed by President Ronald Reagan.

The court ruled that during one of those pro forma sessions on Jan. 3, 2012, the Senate officially convened its second session of the 112th Congress, as required by the Constitution.

Sentelle's opinion was joined by Judge Thomas Griffith, appointed to the court by President George W. Bush, and Karen LeCraft Henderson, who was appointed by President George H.W. Bush.

"With this ruling, the D.C. Circuit has soundly rejected the Obama administration's flimsy interpretation of the law, and (it) will go a long way toward restoring the constitutional separation of powers," said Sen. Orrin Hatch, R-Utah.

GOP House Speaker John Boehner welcomed the ruling as "a victory for accountability in government."

If the ruling stands, it would invalidate more than 600 board decisions issued over the past year. It also would leave the five-member labor board with just one validly appointed member, effectively shutting it down. The board is allowed to issue decisions only when it has at least three sitting members.

Obama used the recess appointment to install Deputy Labor Secretary Sharon Block, union lawyer Richard Griffin and NLRB counsel Terence Flynn to fill vacancies on the labor board, giving it a full contingent for the first time in more than a year. Block and Griffin are Democrats, while Flynn is a Republican. Flynn stepped down from the board last year.

All three vacancies on the labor board had been open for months before Obama acted to fill them.

Sen. Tom Harkin, D-Iowa called the ruling "a radical departure from precedent" and argued that Obama had no choice but to act.

"Throughout his presidency, Republicans have employed unprecedented partisan delay tactics and filibusters to prevent confirmation of nominees to lead the NLRB, thus crippling the board's legal authority to act," Harkin said.

If Obama's recess appointment of Cordray to the newly created consumer board is eventually ruled invalid, it could nullify all the regulations the consumer board has issued, many of which affect the mortgage business.

Disney says JJ Abrams to direct next 'Star Wars'

(AP) ? It's official. The force is with J.J. Abrams.

The Walt Disney Co. issued a statement Friday night confirming reports that had been circulating for two days that Abrams, Emmy-award-winning creator of TV's "Lost" and director of 2009's "Star Trek" movie, has been pegged to direct the seventh installment of the "Star Wars" franchise.

"J.J. is the perfect director to helm this," said Kathleen Kennedy, the movie's producer and president of Lucasfilm, which was acquired by Disney last month for $4.06 billion.

"Beyond having such great instincts as a filmmaker, he has an intuitive understanding of this franchise. He understands the essence of the Star Wars experience," Kennedy said in the statement.

The movie will have a script from "Toy Story 3" writer Michael Arndt and a 2015 release.

Lawrence Kasdan, who wrote "The Empire Strikes Back" and "Return of the Jedi" in the original trilogy, will work as a consultant on the new project.

Abrams has already headed the reboot of another storied space franchise, "Star Trek," for rival studio Paramount Pictures. The next installment in that series, "Star Trek: Into Darkness," is set to hit theaters May 17.

But he has long been known as a "Star Wars" devotee. Abrams spoke about the plot of the original "Star Wars" in the lecture series "TED Talks" in March 2007, and reportedly became enamored of "Lost" co-creator Damon Lindelof partly because Lindelof was wearing a "Star Wars" T-shirt when they first met.

In 2009, Abrams told the Los Angeles Times: "As a kid, 'Star Wars' was much more my thing than 'Star Trek' was."

In Friday night's statement he called it an "absolute honor" to get the job.

"I may be even more grateful to George Lucas now than I was as a kid," Abrams said.

Lucas himself said in the statement that "I've consistently been impressed with J.J. as a filmmaker and storyteller. He's an ideal choice to direct the new Star Wars film and the legacy couldn't be in better hands."

"Cleaning fairy" arrested after shovelling snow without permission

CLEVELAND (Reuters) - The Ohio woman dubbed "the cleaning fairy" by local media because she broke into a home and cleaned it without permission, was arrested on Tuesday after police found her shovelling snow from a driveway without the owner's consent, police said.

Police in Elyria, a city 30 miles southwest of Cleveland, arrested Susan Warren, 53, on an outstanding warrant stemming from the separate incident last year where she entered a suburban Cleveland home, did some light cleaning and left a note charging the owner $75.

She could face jail time for a probation violation but no charges have been brought for the unsolicited snow shovelling, an Elyria Police Department spokeswoman told Reuters on Thursday.

Last November, Warren pleaded guilty to attempted burglary and trespassing in connection with the house cleaning incident in May.

According to Sherry Bush, the owner of the home, she called Warren to question if she had cleaned the wrong home by mistake and was told by Warren that there was no mistake, that she "does this all the time" and thought she was doing Bush a favour. Bush made the remarks on May 30 last year, in an interview on WKYC-TV in Cleveland.

Warren was arrested and given one year of probation. She violated the terms of her probation earlier this month, triggering the warrant for her arrest, according to Cuyahoga County Court records. The records did not specify what Warren did to violate the probation.

Better outlook for dwindling black macaque population in indonesia

Jan. 23, 2013 ? Since at least the 1970s, the population of critically endangered Sulawesi black macaques living in an Indonesian nature reserve has been dropping. But a new study by researchers at the University of Washington and in Indonesia shows that the population has stabilized over the past decade.

The findings, published in the January issue of the American Journal of Primatology, are from the longest ongoing survey of Macaca nigra and are among the first evidence that the monkeys may be in better shape.

"Fifteen years ago it looked like this macaque population would continue its decline and eventually disappear," said Randall Kyes, lead author and UW research professor of psychology. This study "doesn't mean that everything is fine now and that we no longer need to worry about the fate of these animals, but it is good news compared with what we've seen over the past 30-plus years in this reserve."

Since 1997, Kyes and his Indonesian colleagues have conducted conservation-related studies of the black macaques at the Tangkoko Nature Reserve in North Sulawesi, Indonesia -- an area known for its biodiversity, which attracts flocks of tourists each year. He and his team began the newly published population survey in 1999 and collected data through 2011.

Searching a specified section of the forest, the researchers took two daily counts during a two- to three-week survey period each year of the study. They only recorded numbers of black macaques they saw, though they would often hear many others.

The number of groups of macaques per square kilometer (0.40 of a square mile) increased from 3.6 in 1999 to 3.9 in 2005 and to 4.3 in 2011, the research team found. They observed a similar gradual climb in numbers of individuals per square kilometer: 32.4 in 1999, 53.8 in 2005 and 61.5 in 2011.

By these counts, the population size has returned to the level of nearly 20 years ago: a 1994 study reported 3.9 groups and 68.7 individuals per square kilometer. In contrast, a study in 1978, when scientists first began documenting the population's status, showed 10 groups and 300 individuals per square kilometer.

"We've found that the progressive decline has slowed," Kyes said. "Somewhere over the last 10 years the trend has started to turn. We're seeing the population in the balance now, but without the sustained efforts by local and international groups working in the reserve and the support and involvement of the local people, the macaques will likely face further decline."

Hunting and habitat loss are the chief culprits in the black macaque population's waning in recent decades. In North Sulawesi culture, black macaques are considered a food for special occasions, similar to a Thanksgiving turkey for people in the United States and Canada.

Though they did not examine this in their new study, the researchers' outreach education efforts for children who live near the Tangkoko Nature Reserve may be helping to decrease illegal hunting and trapping of the animals. The researchers also hold an annual field course in conservation biology and global health for local university students and the community.

"We focus on the importance of the human-environment interface and the close relationship between environmental health and human health," Kyes said. "We also emphasize how the black macaques support the local economy, by way of all the tourists who come to the nature reserve to see them."

He said that outreach to children is particularly helpful. "We don't chastise them for eating monkeys, but we do explain that there might not be many left in the future. We encourage them to ask their parents if there's something else they can eat."

Co-authors in Indonesia are Entang Iskandar of Bogor Agricultural University's Primate Research Center; and Jane Onibala, Umar Paputungan and Sylvia Laatung of Sam Ratulangi University. Co-author Falk Huettmann is from the University of Alaska-Fairbanks.

The study was funded by the Woodland Park Zoo in Seattle, One Earth Institute in Seattle, the International Primatological Society and the National Institutes of Health.
